(Address) (Date) Senator Ben Nighthorse-Campbell, Chairman Senate Committee on Indian Affairs 838 Hart Senate Office Building Washington, D.C. 20510 RE: Support of the an Immediate Investigation into the Conduct and Actions of the Eastern Regional BIA Offices Involvement with the Catawba Nation's Tribal Enrollment Process. Dear Senator Nighthorse-Campbell: I am an enrolled member of the Catawba Nation and am supporting a recent request by individuals who have been denied Catawba tribal enrollment. As a member of the public and the Catawba Nation, I am dismayed that the Bureau of Indian Affairs Central and Eastern Offices have been allowed to deny the petitioners due process protection rights guaranteed under the United States Constitution. This is a national disgrace that a federal agency has been allowed to ignore communications by these people, to provide conflicting enrollment standards or none at all, and in general to mislead the public that an objective review of their enrollment would be conducted. Anyone slightly familiar with these events can quickly discern that the most rudimentary procedures of review were never established prior to and including the final denial of Catawba enrollment for these individuals. More shocking, however, is Mr. Franklin Keel's current efforts to rush to publication the Final Catawba Membership roll when he is involved in a related federal law suit in South Carolina, and has been notified that on July 11, 2000 he is to appear at a pre-trial hearing in Denver Federal District Court. The July 11th hearing is a pre-trial hearing involving the core elements of the Catawba Nation's enrollment procedures, which includes legal arguments that Ms. Judy Canty Martin has been denied her Constitutional rights by Mr. Keel's actions. Mr. Keel stated on Thursday, June 23, 2000 that he will be making every effort to have the Catawba Final Membership Roll published in the Federal Register and in three local newspapers prior to the July 11th pre-trial hearing in Denver. Should the courts in Colorado and/or South Carolina find against Mr. Keel and BIA's conduct, this will result in additional and very expensive republication efforts on the part of the federal government. This of course means that the taxpayers will be paying once again for the failings of the Bureau of Indian Affairs to have done its job to the public and all Indian people. I fully support the call for an immediate Senate Committee on Indian Affairs investigation into the conduct and acts of omission by the Bureau of Indian Affairs, including the conduct of Mr. Kevin Gover and Mr. Franklin Keel.
